If you’re a podcaster or content creator who regularly interviews people, it’s a good idea to set out your legal relationship with any people you speak to, interview or collaborate with, especially if you’re looking at commercialising your work.

An Interview Talent Release ensures you have explicit permission from any people you feature on a podcast to broadcast or publish what they say. In this Interview Talent Release Checklist we set out the key terms needed to define your arrangement and the rights attaching to the content you create. 1. Parties

A. What is the name, address and ABN of the Podcaster or Creator?
B. If the Podcaster or Creator works for or through a company, provide the company's name, address and ABN.
C. What is the name, address and ABN of the Talent or Guest?
D. If the Talent or Guest works for or through a company, provide the company's name, address and ABN.

2. Podcast Recording Details

A. What is the name of the Podcast or program?
B. What are the dates and times the Talent or Guest will be required for interviews/recording sessions?
C. Where or how will interviews/recording sessions take place (i.e. over the phone, via Skype or Zoom, or in person)? If recording will take place in person, provide the name and address of the recording studio or location.
D. Will the recordings be solely audio based or will filming of interviews/recording sessions also take place?

3. Fees and Expenses

A. What fee (if any) will the Talent or Guest be paid?
B. When will the Fee be paid (e.g. in instalments, before or after the recording session(s))?
C. Is GST payable?
D. Will the Talent or Guest require any expenses to be covered by the Podcaster or Company (e.g. flights, transport or accommodation)? If so, what are they?
E. What insurances (if any) are required to be maintained by either party?

4. Ownership, Use and Approvals

A. What rights of approval (if any) will the Talent or Guest have in connection with the recordings?
B. What rights, ownership, or licence to use (if any) will the Talent or Guest get in the recordings?
C. If there are any special conditions around ownership of recorded material involved between the Podcaster/Creator and Talent/Guest, please provide those details.

5. Publication, Promotion and Credit

A. On what platforms and in what formats will the Podcast or Program be published or released?
B. How will the Podcast or Program be promoted and will the Talent or Guest be involved in such promotions?
C. What credit or acknowledgement will the Talent or Guest be given?
D. Will there be any specific requirements for placement of a credit or acknowledgement? If so, what are those requirements?

6. Termination and Cancellation

A. What rights does the Talent or Guest have to terminate the agreement, including withdrawing permission to conduct or release recordings?
B. How much notice is needed by either party to cancel a scheduled recording session?

7. Special Conditions

A. List any other 'special conditions' not listed above, which may apply to your arrangement.
