Set out below are the important questions you need to address in any Music Producer Agreement. 1. Parties to the Contract

A. What is the name, address and ABN of the party engaging the Producer?
B. What is the name of the featured Artist on the track(s)?
C. What is the name, address and ABN of the Producer?
D. Does the Producer operate through a company? If so, what is the company’s name?

2. Producer's Services

A. What services will be provided by the Producer? (E.g. Create budgets, mixing and mastering, obtain performer consents, etc.)
B. What are the names of the track(s)/composition(s) to be produced?
C. Will the Producer work entirely separately to the Artist or under the instruction of the Artist?
D. What is the name and address of the studio in which the track(s) will be produced?
E. Who will be responsible for clearing samples/synchs and obtaining any performer releases?

3. Delivery

A. What needs to be delivered by the Producer, and to whom?
B. What are the technical requirements for the deliverables (e.g. specific formats, specifications or durations)?
C. Are stem files required to be delivered?
D. How long will the Producer have to deliver the track(s) and related materials?
E. How many tracks/versions will be produced, if known?

4. Credit and Promotion

A. What credit(s) will the Producer be given?
B. Are there any specific conditions on the credit?
C. Will there be any limits on the right to use and publish the Producer’s name, biographical material or image?
D. Who will release and promote the track, and under what name?

5. Payment to Producer and Expenses

A. What will the Producer be paid?
B. How will the Producer's Fee be calculated (e.g. per-track fee) and will it (or any part of it) be treated as an advance?
C. Will the Producer be entitled to any royalties or income from the track (e.g. net profit or ‘points’)?
D. Will the Producer be entitled to be reimbursed for any particular expenses?
E. When will the Producer be paid?

6. Recording Costs/Budget

A. Who will pay any costs relating to the production of the masters/track(s)? (E.g studio hire, equipment hire, session musicians and any other production-related costs.)
B. What is the budget? Does the budget include the Producer's Fee?

7. Copyright and Ownership

A. Who will own the master recordings/tracks?
B. Will the Producer own any part of the composition (e.g. will the Producer be helping to co-write the songs)?

8. Approvals and Restrictions

A. Will the Artist and/or Producer have any rights of approval? (E.g. synch licences, timing of release or sample usage.)
B. What rights will the Artist and Producer have to adapt, edit, mix, re-mix or delete the track(s)?
C. Will there be any restrictions on use of the track (e.g. re-recordings of the track)?
