When an artist, DJ, remixer or producer is engaged to remix a musical work or track, a Remixer Agreement is needed to set out the terms of the arrangement.

This Remixer Agreement Checklist sets out the terms that should be included in a Remixer Agreement. These questions will help identify what the exact remixer services are, what the producer is required to deliver, what they will be paid and who owns the final product.

Fill out the checklist below to get started with a Remixer Services Agreement. If you can’t answer certain questions, you’ll probably need legal advice, so just put ‘I don’t know’ or get in touch!

1. Parties to the Contract

A. What is the name, address and ABN of the party engaging the Remixer?
B. What is the name of the featured Artist on the track?
C. What is the name, address and ABN of the Remixer?
D. Does the Remixer operate through a company? If so, what is the company's name?

2. Remixer's Services

A. What services will be provided by the Remixer?
B. What is the name of the track/composition to be remixed?
C. Will the Remixer work entirely separately to the Artist or under the instruction of the Artist?
D. Who will be responsible for clearing samples/synchs and obtaining any performer releases?

3. Delivery

What does the Remixer need to deliver (e.g. any specific formats, technical specifications or durations required)?
B. To whom should the Remixer deliver to?
C. Will stem files be required to be delivered?
D. How long will the Remixer have to deliver the remixes and related materials?
E. How many tracks/versions will be produced, if known?

4. Credit and Promotion

A. What credit(s) will the Remixer be given?
B. Are there any specific conditions on the credit?
C. Will there be any limits on the right to use and publish the Remixer's name, biographical material or image?
D. Who will release and promote the remix, and under what name?

5. Payment to Remixer and Costs

A. What will the Remixer be paid, how will this be calculated and will it be treated as an advance?
B. Will the Remixer be entitled to any royalties or income from the remix (e.g. net profit or 'points')?
C. When will payment of the Remixer take place?
D. Who will pay any costs relating to the production of the remix?

6. Copyright

A. Who will own the remix?
B. Will the Remixer own any part of the newly created composition? If so, what will it be called?

7. Approvals and Restrictions

A. Will the Artist and/or Remixer have any rights of approval (e.g. for synch licences, timing of release or sample usage)?
B. What rights will the Artist and Remixer have to further adapt, edit or delete the remix?
C. Will there be any restrictions on use of the remix or the original track?
